Unless specifically stated in a signed written agreement, www.Excellerate-hr.com does not represent that Excellerate-HR is providing software development, managed IT services, cybersecurity services, system integration, cloud implementation, ERP implementation, technical support, or other IT consulting services through this website. Any IT consulting services, if offered by an affiliated Excellerate entity, are governed by a separate agreement and scope.
3. No Employment or Placement Guarantee
Submitting a resume, inquiry, application, staffing request, job order, or contact form does not guarantee interview selection, job placement, hiring, assignment, continued work, candidate availability, candidate acceptance, employee retention, or client engagement. Hiring and placement decisions depend on lawful client requirements, candidate qualifications, availability, background/credential verification, work authorization, compensation alignment, location, shift requirements, and applicable law.
4. No Legal, Tax, Immigration, Payroll, or Professional Advice
Website content and communications from Excellerate are not legal, tax, immigration, accounting, payroll, insurance, safety, medical, or professional advice. Clients, candidates, and workers should consult qualified professionals for advice specific to their circumstances. Excellerate may provide administrative or coordination support, but final compliance responsibility remains with the party legally responsible under applicable law and the governing written agreement.
5. Client Responsibility
Clients are responsible for providing lawful job requirements, accurate role descriptions, safe working conditions, wage/hour compliance, anti-discrimination compliance, assignment supervision, workplace policies, required licenses, industry-specific compliance, and timely feedback unless otherwise expressly agreed in writing. Clients must not request discriminatory screening, unlawful exclusions, or non-job-related criteria.
6. Candidate and Worker Responsibility
Candidates and workers are responsible for providing truthful and complete information, maintaining current contact details, disclosing relevant availability or restrictions, following workplace rules, protecting client property and confidential information, and complying with applicable laws and assignment requirements. Misrepresentation may result in withdrawal from consideration or termination of assignment, subject to applicable law.
7. Background Checks, Verification, and Screening
Any background checks, drug testing, credential verification, employment verification, reference checks, identity checks, work authorization checks, or assessment processes are conducted only when required, permitted, and authorized under applicable law and written procedures. Passing a screening process does not guarantee placement, and failure to provide required documentation may delay or prevent placement.
8. Equal Opportunity Disclaimer
Excellerate supports equal opportunity and lawful hiring practices. We do not knowingly participate in discriminatory recruiting or staffing practices. Any client requirement that appears unlawful, discriminatory, unsafe, or inconsistent with applicable employment law may be rejected or escalated for review.
